A. Weekly Annotated Gazette Indexes

INTRODUCTION

The 
Government Gazette contains important information about the law and administrative actions under the law. However, it is so voluminous that reading the Gazette in full is impractical. In addition, their indexes are often so cryptic and their item titles so undescriptive as to be of little use. These problems are decades old (see this 1948 Cape Times article) and we thought it time to resolve them.

Our unique solution

Our Weekly Annotated Gazette Indexes provide a weekly, searchable, electronic index to the full title of items in the National and all Provincial Gazettes which were issued during the week. Item titles are annotated where necessary with additional information from the text of the item, where we feel the title is misleading, cryptic or undescriptive. In addition, the annotated item titles are listed under the legislation in terms of which, or under which, the item was published. Where that legislation was published 1994 on, we also provide free-to-access links to the overviews of legislation, and (in the case of post-1993 national legislation) free-to-access text of that legislation as unamended. S
ubscribers can therefore cost- and time-effectively keep themselves updated with the legislative and regulatory matters in the Gazettes by doing keyword searches for matters of particular interest, or by checking under particular legislation to see if anything of importance was published during the week. Where our subscribers need hard copes of the actual items in the Gazettes, we will either assist them in subscribing to the hard copies of the Gazettes through the relevant government offices, or we will scan and email copies of particular Gazette items, at a minimum and per page fee, as and when requested.

D. STAQ-based Compliance and Transgression Testing

INTRODUCTION

Compliance and transgression testing requires close and expert analysis of legislative texts, and usually fairly complex systems and advanced audit skills are developed for compliance maintenance programmes. However, often the necessary skills and systems are non-existence or lacking, and the cost of developing these, or buying them in, is exorbitant.

Our unique solution

We provide developed a unique system of standardized, online, interactive STAQ transgression
questionnaire, which substantially reduce your reliance on costly in-house or outside expertise in developing and maintaining your compliance programme.  STAQs consist of a carefully structured list of factual questions, developed through a process of content analysis, which assists you to determine whether factual transgressions of legislation have occurred. They do not require any particular expertise to administer other than skills which are typically found in virtually every organisation, and the process of administering STAQs does not have to involve costly expertise or the time of those in your organisation who call ill afford it.  STAQ Transgression Reports, generated on completion of a STAQ, specify whether any factual transgression have been found and identify the exact set of particular facts which should be considered a factual transgression.  STAQs can used to evaluate the compliance of multiple potential transgressors simultaneously, and can be used as the basis upon which to develop a compliance programme, or can be easily integrated into an existing compliance programme. E. Consultancy

INTRODUCTION

Most compliance teams consist of those with technical and management skills, and perhaps someone with legal advisor skills. Specific legislation and legislation analysis skills are usually not included in the team, even although it is legislation which underpins and drives the need for compliance.  The shoes of a legislation analysis expert is usually filled by a legal consultant, even although their field of expertise is usually not that of legislation analysis, but of providing legal advise. However, legal advice is largely superfluous until a transgression is imminent or actually arises.

Our unique solution

Within the compliance programme, we provide expertise in legislation analysis based in content analysis, rather than legal analysis, with the objective of ensuring that the focus of the compliance programme and the endeavours of the compliance team remain four square within legislative necessity.
