A. Weekly Annotated Gazette Indexes

INTRODUCTION

The Government Gazette contains important information about the law and administrative actions under the law. However, it is so voluminous that reading the Gazette in full is impractical. In addition, their indexes are often so cryptic and their item titles so undescriptive as to be of little use. These problems are decades old (see this 1948 Cape Times article) and we thought it time to resolve them.

Our unique solution

Our Weekly Annotated Gazette Indexes provide a weekly, searchable, electronic index to the full title of items in the National and all Provincial Gazettes which were issued during the week. Item titles are annotated where necessary with additional information from the text of the item, where we feel the title is misleading, cryptic or undescriptive. In addition, the annotated item titles are listed under the legislation in terms of which, or under which, the item was published. Where that legislation was published 1994 on, we also provide free-to-access links to the overviews of legislation, and (in the case of post-1993 national legislation) free-to-access text of that legislation as unamended. Subscribers can therefore cost- and time-effectively keep themselves updated with the legislative and regulatory matters in the Gazettes by doing keyword searches for matters of particular interest, or by checking under particular legislation to see if anything of importance was published during the week. Where our subscribers need hard copes of the actual items in the Gazettes, we will either assist them in subscribing to the hard copies of the Gazettes through the relevant government offices, or we will scan and email copies of particular Gazette items, at a minimum and per page fee, as and when requested.

INTRODUCTION

The process of keeping informed about new and amended legislation should, but often does not, be part of the broader and more complex system and detailed analysis required to determine whether new and amended legislation relates to you, when it came into force, how it relates to you, and what needs to be done to comply with it or to avoid its transgression.

Our unique solution

We provide electronically accessible to unamended and amended legislative texts from 1994 on, annotated with additional information about amendments to section and commencement of amendments, and we notify you when there are changes to these texts and we provide you with texts as amended. However, in addition, we facilitate the integration of this process with the wider processes referred to above, by ensuring the following:

We present the text of Acts in a simple, modern font, with clear indents, and no unnecessary textual embellishments. This makes them easy to read and allows you to concentrate on understanding rather than reading the text.

We present the text of Act as a whole, so that moving between different parts of the Act is an easy process. We do not use the frustrating system of provide the texts of Acts, section by section, in different documents.

Your access to amended Acts is not limited to only the current amended version of the Act

You have access to each and every version of an Act over its lifespan, as unamended and as variously amended. This allows you to directly compare an older version of an Act with its newer version, so that you can understand what changes were made, and the effect of the changes. It also allows you to relate a set of past facts to the version of the Act that was valid at the time the facts existed. This is useful for example, in evaluating past non-compliance or past obligations
You also have access to the full text of an amending Act, rather than a summary of only the headings of the amending Act. We do this because by looking at an amending Act, it is often really easier to check exactly what amendments were made to an amended Act. It also provides you with away to verify the final amended version of an amended Act.

Our legislative texts reflect as accurately as possible the intentions of the legislature, as well as any errors made by the legislature and others

The text of amended Acts include, where necessary, our unique system of marks to indicate unmarked omissions and unmarked insertion errors made by amending legislation. This allows us to avoid the necessity of second-guessing the intention of the legislature, and provides you with an unsanitized version of the Act, as amended.

You are able to quickly come to grips with everything about an Act

Each Act has an overview, accessible at its head, that contains the long title of the Act, a table of its section titles, a timeline history of commencements and amendments for each section of the Act, and links to the text of each and every version of the Act.

You are able to relate the Act under your consideration to other Acts in our database

The head of each Act contains quick links to its parent database. Considering that many Acts are cross-linked to many others, this allows you to move from one Act to another quickly and efficiently.

We provide additional information to assist you analyse the Act, and apply it in your circumstances

For our subscribers who have taken out additional subscriptions, the head of each Act in our database also provides links to a subordinate legislation list, potential transgressor lists, commentary on procedural and substantive issues arising, and transgression testing STAQ tools.

Below each section of an Act, in grey text, we provide a compact list of amendments to the section, a reference to the amending legislation, and the dates of commencement of each of the amendments. In addition, each subsection of the Act is annotated with a brief history of amending legislation and changes in labeling.

D. STAQ-based Compliance and Transgression Testing

INTRODUCTION

Compliance and transgression testing requires close and expert analysis of legislative texts, and usually fairly complex systems and advanced audit skills are developed for compliance maintenance programmes. However, often the necessary skills and systems are non-existence or lacking, and the cost of developing these, or buying them in, is exorbitant.

Our unique solution

We provide developed a unique system of standardized, online, interactive STAQ transgression questionnaire, which substantially reduce your reliance on costly in-house or outside expertise in developing and maintaining your compliance programme. STAQs consist of a carefully structured list of factual questions, developed through a process of content analysis, which assists you to determine whether factual transgressions of legislation have occurred. They do not require any particular expertise to administer other than skills which are typically found in virtually every organisation, and the process of administering STAQs does not have to involve costly expertise or the time of those in your organisation who call ill afford it. STAQ Transgression Reports, generated on completion of a STAQ, specify whether any factual transgression have been found and identify the exact set of particular facts which should be considered a factual transgression. E. Consultancy

INTRODUCTION

Most compliance teams consist of those with technical and management skills, and perhaps someone with legal advisor skills. Specific legislation and legislation analysis skills are usually not included in the team, even although it is legislation which underpins and drives the need for compliance. The shoes of a legislation analysis expert is usually filled by a legal consultant, even although their field of expertise is usually not that of legislation analysis, but of providing legal advise. However, legal advice is largely superfluous until a transgression is imminent or actually arises.
