INTRODUCTORY

 

Imagine, for the purpose of this user guide, that your company has just discovered that a piece of land it bought some time ago was badly polluted by the previous owner, and that it will cost at least R850,000 to clean up the mess.  The pollutants are not interfering with your company’s use of the land, and you feel that your company should not be held in transgression of any law if it left the pollutants on that land, but that perhaps it would have to make sure that the previous owner clean up the mess or pay for you to the cleanup.  However, you are not really sure if this is the case.  You particularly want to find out if your company would be in transgression of any law for not cleaning up the pollutants itself.

 

Using this scenario, we will work through this User Guide to:

 

 list relevant legislation

 

 decide which legislation on the list is most relevant to possible transgressions

 

 decide which sections of such legislation are most relevant

 

 identify potential transgressors who are at risk of transgressing those sections

 

 test for transgressions of those sections, and if a transgression is found..

 

 identify the factual causes of that transgression
