The Usual Problem

Most products and services that are geared to achieve and maintain compliance, do so by imposing complex, externally generated and maintained solutions, which are difficult to internalize.

The uncomfortable fit between such solutions and the organization’s limited capacity to internalize these, results inevitably in ongoing great expense and/or failure of the whole exercise.

We did not accept that this usual problem was inevitable, and we went about developing a philosophy, and matching products and services, that would allow these problems to be surmounted.

Our Compliance Philosophy

Compliance and compliance-maintenance systems just have to become part of the systemic structure and functioning of the organisation upon which the compliance and compliance maintenance solutions are imposed, in order to avoid unnecessary expense and possible failure.

With this in mind, our starting point was that it is obvious that the only way to establish whether or not an organisation is in compliance with legislation, is to establish whether or not it is in factual transgression of the legislation. (Note that we define a “transgression” as a fact or set of facts precluded by legislation, and “compliance” as the absence of any transgression).

A second starting point was that it is also obvious that, in making the factual enquiry into transgressions, compliance products and services just have to utilise the systemic capacity and strengths of an organisation, so that the organic integration by the organisation of such products and services into its own structures and functioning, and where necessary the systemic organizational infrastructural changes to facilitate the ongoing monitoring and maintenance of legal compliance and transgression knowledge, become possible.

Our Product Solution

Our STAQ products offer a uniquely simple compliance and compliance-maintenance solution that is widely applicable, and will be a good fit with virtually any organization, because they maximize the organization’s involvement in and utilization of its own existing internal resources in the process of identifying transgressions and maintaining compliance, and do not impose complex external compliance solutions that are in themselves difficult to comply with and maintain.

Use of our STAQ products has many additional, knock-on benefits for an organisation, aside from assisting it to easily identify transgressions of and maintenance of compliance. A unique parallel effect of using our STAQ products is the systemic flow of lateral and vertical information and knowledge throughout the organization, that results in a systemic involvement by the organization in its own compliance and compliance-maintenance processes, decisions and outcomes. Such unique knock-on effects will occur whether or not our STAQ Products are used in conjunction with other compliance products and services which the organization may be using, and can therefore only enhance the effectiveness of any other compliance and compliance-maintenance products and services currently in use.

Our Service Solution

Only where there is a lack of internal capacity to identify or establish particular facts, would our STAQ system require that the organisation either enhance its own capacity to identify or establish facts required to answer STAQ questions, or buy in the outside expertise necessary to do so.

Our services are specifically geared to minimize the need of an organization to buy in outside solutions and expertise, and where that fails, to limit the cost of doing so.

To this end our services have a two-fold purpose and focus: Firstly, the delivery of structured information specifically geared to assist with the identification of those facts and/or causal relationships needed but not available to the enquiry into transgressions, and secondly the delivery of a referral service that will ensure that outside experts pulled into the process of establishing whether environmental transgressions have occurred and compliance achieved, are appropriate, focused, and cost-effective.

The Result

In sum, the development of our compliance philosophy has enabled us to successfully develop STAQ products and a set of Client Referral Services to assist our clients to themselves deal with complex issues of compliance as simply and as far as possible.

Where this is not possible because of a lack of client capacity and resources, our products and services minimize the cost of our clients using outside resources and expertise by assisting our clients to pinpoint the resources and expertise needed, without prejudicing our client’s ability to develop a capacity deal with these issues itself.
