School Education Amendment Act (Mpumalanga), No. 7 of 1998

Long title

To amend the School Education Act (Mpumalanga), 1995, so as to define or further define certain expressions; to prohibit the administering of admission tests at public schools; to grant to the Head of Department certain powers regarding compulsory school attendance; to provide for the registration of learners for education at home; to prohibit the prevention of learners from attending school; to regulate parents' liability for the payment of school fees; to provide for the adoption of a code of conduct by schools; to regulate the suspension and expulsion from a public school; to further regulate the prohibition of corporal punishment; to further regulate governing bodies and the membership thereof of public schools, public schools for learners with special education needs and hostels; to provide for the adoption of a constitution by a public school; to provide for the recusal by and the reimbursement of members of governing bodies; to provide for the appointment of office-bearers of governing bodies and their terms of office; to provide for the establishment of committees of governing bodies; to regulate the status of minors on governing bodies of public schools; to regulate the powers and functions of all governing bodies; to provide for the allocation of further functions to governing bodies; to replace certain references to the Member of the Executive Council with references to the Head of Department; to provide for the withdrawal of functions from governing bodies; to provide for the establishment of a representative council of learners; to further regulate the provision and closure of public schools; to regulate public schools on state property as well as private property; to further regulate schools fees at public schools and the enforcement thereof; to further regulate the funds and assets of public schools; to repeal the provisions with regard to state-aided schools; to further regulate the duties of the Member of the Executive Council relating to public schools, to repeal the provisions with regard to schools. in rural areas; to provide for transitional provisions relating to governing bodies; to repeal the provisions with regard to transitional provisions relating to state schools; to provide for transitional provisions relating to schools other than private schools as well as to public schools on private property; to repeal the provisions with regard to the declaration of public schools to be state schools and state-aided schools; to provide for transitional provisions relating to private schools; to repeal the transitional provisions with regard to model C schools and state-aided schools as well as negotiating forums; to further regulate indemnities; to provide for the expropriation of land for schools purposes; to provide for the liability of the State; and to substitute certain words and expressions; and to provide for matters connected therewith.
