Mpumalanga Gaming Amendment Act, No. 12 of 1998

Long title

To amend the Mpumalanga Gaming Act, 1995, so as to define or further define certain expressions; to effect certain consequential Constitutional amendments; to provide for the representivity of the Board; to further regulate the payment of members of the Board; to further regulate the disclosure of information by a Board member, staff or inspector of the Board; to further regulate financial interests in gaming by family members of the Board; to provide for the payment of money standing to the credit of the Board at the end of the Board's financial year, into the Provincial Exchequer account; to provide for the furnishing of quarterly reports by the Board to the responsible Member; to further regulate the granting of casino licences by the Board; to provide for the payment of investigation fees to the Board; to further regulate the gathering of information regarding the suitability of licence holders; to further regulate the transfer, removal and amendment of licences; to provide for the prohibition of licensees contracting with third parties; to provide for the establishment of a list of persons who are to be excluded from licensed premises and prohibited from participating in gaming; to provide for the payment of application fees, investigation fees and licence or certificate fees into the Provincial Revenue Fund by the Board; to provide for the development of additional facilities by an applicant for a casino licence in consideration of the guaranteeing by the Board of exclusivity in respect of gaming; to further regulate the restrictions applicable to employees employed in the gaming industry; to further regulate the powers of police officers and inspectors to search certain premises; to provide for circumstances in which premises may be searched without a search warrant; to repeal certain provisions relating to grounds for review, powers on review and appeals to the Supreme Court; to further regulate certain prohibitions in respect of gaming; to provide for the increase of the fine that may be imposed by the Board for a contravention of the Gaming Act, from R10 000 to R1 000 000; to further regulate the application of the Gaming Act; and to provide for matters connected therewith.
