Long title

To amend the Mpumalanga Gaming Act, 1995, so as to define or further define certain expressions; to amend the name of the Board and of the principal Act to Mpumalanga Gambling Board and Mpumalanga Gambling Act respectively; to change the word "gaming" to "gambling" wherever it appears in the Act; to determine the powers of the deputy chairperson of the Board in the event that the chairperson is unable to act; to revise the provisions pertaining to the funds of the Board, the accountability of the Board and the reporting requirements by the Board in accordance with the provisions of the Public Finance Management Act, 1999; to further regulate investigations, hearings and enquiries by the Board; to further regulate disqualification for licences in general; to provide for route operator, site operator and independent site operator licences in accordance with the provisions of the National Regulations on Limited Payout Machines, 2000 and the National Gambling Act, 2004; to further regulate applications for licences; to provide for the incorporation of application fees in the form of a schedule to the Act; to further regulate applications and objections to be open to the public; to provide for public hearings and recording requirements pertaining to application proceedings; to provide for the linking of gambling machines and gambling games to wide area progressive jackpots and to grant to the Board the ability to enter into agreements with other licensing authorities outside the Province with regard thereto; to further regulate route and site operators; to provide for independent site operators; to further regulate bingo operators and to provide for the linking of bingo games and to grant the Board the ability to enter into agreements with other licensing authorities outside the Province with regard thereto; to further regulate manufacturers, maintenance providers and suppliers; to further regulate the transfer, removal and amendment of licences and to provide for a simplified procedure in the event that a licensee wishes to amend its name; to further regulate the general conditions of licences and to provide for a duty upon a licensee to obtain approval from the Board prior to changing any information furnished in support of an application that led to the issue of a licence; to further regulate electronic monitoring systems for gambling machines; to provide for financial and controlling interests in the business of a licensee; to further regulate the suitability of third parties; to further regulate gambling devices; to further regulate advertisements; to further regulate assistance to customers; to provide for the expiry of a licence; to provide for the duty placed upon a site operator to display its licence at the entrance to the designated area together with a copy of the licence of the route operator; to provide for the duty of a holder of a certificate of suitability and the holder of a certificate of approval to produce the certificate on demand to an inspector or police officer; to further regulate the suspension or withdrawal of certificates of approval; to further regulate the restrictions applicable to employees; to further regulate the functions and powers of inspectors; to provide for contracts procuring financial and controlling interests; to further regulate the relinquishing or foregoing of certain rights, privileges, obligations and liabilities; to further regulate prohibition in respect of gambling; to further regulate the prohibition of certain persons from entering licensed premises and to provide for the inclusion of excluded persons; to further regulate the prohibition of certain devices, machines, contrivances or instruments; to further regulate the prohibition in respect of manufacture, sale, distribution and modification of gambling equipment and devices; to further regulate the prohibition of cheating and cheating devices; to further regulate offences in general; to further regulate declarations of forfeiture; to repeal certain provisions relating to punitive gambling levies; to further regulate disciplinary competencies of the Board; to further regulate the application of the Act; to provide for rewards for informers; to amend the Mpumalanga Gaming Act, 1995, so as to align certain sections of the Act with the National Gambling Act, 2004, and with certain provisions of other Provincial Legislation; and to provide for matters connected therewith.
