Text Box: SOUTH AFRICAN LEGISLATION RESOURCES Local Government Legislation BY-LAWS AND SUBORDINATE TEXTS By-laws and subordinate texts There are numerous local government authorities in South Africa, which in terms of the Constitution of the Republic of South Africa Act, No. 108 of 1996, form a distinct third tier of government, which has its own competencies to make legislation, commonly referred to as “by-laws”.
Local authority by-laws, and notices under these, are published in the relevant province’s Provincial Gazette. Please contact us for assistance in obtaining by-laws and notices under by-laws. NOTE: Local authorities are also responsible for certain pre-1994 national, regional and local legislation which are assigned to them as and when competencies allow, and for certain more recent national and regional legislation delegated to them. Updates on by-laws and subordinate texts Updates on by-laws and subordinate texts are available on a weekly basis through our Weekly Annotated Gazette Indexes, for the province within which the local authority falls, which provide a weekly list of titles of texts published, indexed under the specific legislation in terms of which the text was made.
